The words below, whose first letter is capitalized, will be defined as follows in the present
Acceptance: validation by the Customer of his order.

General Terms of Delivery: refers to the present terms of delivery described below.

Terms of Delivery: refer to the General Terms of Delivery and the special terms of delivery described in www.evidentielle.ch.

Terms and Conditions: refer to the present terms and conditions of sale described below.

Terms and Conditions of Sale: refer to the General Terms and Conditions of Sale and the special terms and conditions of sale described on the www.evidentielle.ch website.

Customer: Internet user placing a firm order, on his own behalf or on behalf of a legal entity, for Products on the www.evidentielle.ch website.

Legal Notice and Conditions of Use: refers to the legal notice and conditions of use of the www.evidentielle.ch website, including limitations of liability.

Product: products and/or services offered for sale on the www.evidentielle.ch website.

Delivery territory: Switzerland

Preamble

EVIDENTIELLE SARL is a Swiss-based company that designs and manufactures natural-based cosmetics.  

The Customer accepts the Conditions of Sale and Conditions of Delivery of the Products, as well as the Legal Notice and Conditions of Use of the www.evidentielle.ch website, which govern the contractual relationship between the Customer (natural person or legal entity) and EVIDENTIELLE SARL, in particular when the Customer purchases a Product on the www.evidentielle.ch website .

The customer of www.evidentielle.ch declares that he/she is domiciled in Switzerland, that he/she is legally capable of entering into a contract and, if applicable, that he/she can validly represent the person on whose behalf he/she is entering into a contract.

Customers of the www.evidentielle.ch website declare that they have the skills and means necessary to subscribe, access and use the services offered by EVIDENTIELLE SARL.

Intellectual property / copyright

The entire www.evidentielle.ch site , texts, photos, videos, sounds, descriptions, quality charter, products, logo, brand, formulas, absolutely all content is the sole property of EVIDENTIELLE SARL. Any copy, total or partial, is forbidden. The EVIDENTIELLE SARL brand may not be used without prior written agreement with the brand.

Product description

EVIDENTIELLE SARL offers online purchasing of Products on the www.evidentielle.ch website.

The photos of the Products on the www.evidentielle.ch website are not contractual.

The Products are described in more detail on the www.evidentielle.ch website.

Prices are specified on the www.evidentielle.ch website for each of the Products, as well as the delivery costs for shipping them to the address chosen by the Customer.

Order validation

After having read the description of the different Products offered, their prices, the Terms of Use, the Legal Notice, the Terms of Sale and the Terms of Delivery, the Customer selects the Product(s) he/she wishes to order, as well as the delivery method for the Products.

By placing an order, the customer acknowledges that he/she has read the special terms and conditions of sale contained in the pages of the www.evidentielle.ch website (weight, quantity, specific use) and expressly declares that he/she accepts them without reservation.

When the order is validated, the Customer may :

• to modify its choices,
• reread the General Terms and Conditions of Use and the General Terms and Conditions of Sale,
• Accept the order by clicking on the "Confirm your order" button.

Acceptance implies total and unconditional acceptance by the Customer of these Conditions of Sale as well as the General Conditions of Use and Conditions of Delivery of the www.evidentielle.ch site, subject to any derogatory provisions established in writing between EVIDENTIELLE SARL and the Customer.

In the absence of proof to the contrary, the data supplied by the Customer and recorded by EVIDENTIELLE SARL constitute proof of the elements of the contract and the terms and conditions governing the relationship between EVIDENTIELLE SARL and the Customer.

After Acceptance, the Customer will receive an e-mail confirming his/her order at the e-mail address indicated. This e-mail will confirm receipt of the Customer's order by EVIDENTIELLE SARL.

In the event of an abnormally large order from a Customer, EVIDENTIELLE SARL reserves the right to cancel the order and to contact the Customer to inform him of this.

EVIDENTIELLE SARL reserves the right to validate the Customer's identity before delivering the Product to the Customer.

Validity of the information provided

The Customer of the www.evidentielle.ch website undertakes to provide true, accurate and up-to-date information at the time it is entered in the service registration form.

If this is not the case, EVIDENTIELLE SARL declines all responsibility in the absence of total or partial delivery of the Products ordered by the Customer.

Price

EVIDENTIELLE SARL reserves the right to modify the prices of its Products at any time in accordance with the procedure described in "Modifications to the General Terms and Conditions of Sale". In any event, the Products will be invoiced on the basis of the price of the Products displayed at the time of Acceptance.

Payment

Payment for Products ordered must be made by :

• Credit card (Visa or Mastercard)
• Post-finance
• TWINT

The online payment service is secure, but does not include any additional insurance policy, particularly in the event of theft of the customer's bank card.

In the event of non-payment due to fraudulent use of a means of payment, EVIDENTIELLE SARL reserves the right to charge the Customer additional handling fees.

It is the Customer's responsibility to check the payment dispatch form before any Acceptance.

In any case, EVIDENTIELLE SARL cannot be held responsible for problems or delays linked to the functioning of payment procedures.

The sums paid within the framework of an online payment will not be able to in no case to be qualified as down payments or installments.

Modification of the Terms and Conditions

EVIDENTIELLE SARL reserves the right to modify and supplement the present General Terms and Conditions of Sale, as well as the scope of its services vis-à-vis the Customer of the www.evidentielle.ch website .

These modifications will come into force at the time they are put online on the www.evidentielle.ch website , it being understood that the price of the Product will in any case be that displayed at the time of Acceptance.

Delivery services

Subject to special stipulation, and from the day of order preparation, the Products ordered will be delivered in the Delivery Territory (Switzerland).

Shipping costs are not included in the prices of the Products as displayed on the pages of the www.evidentielle.ch website describing the Products. However, when the order is validated, the price will include the costs relating to the delivery of the Products.

Delivery and shipping costs

The customer pays a delivery charge of CHF 7.00 for orders under CHF 100.00. For orders over CHF 100, delivery is free.

Delivery times are expressed as follows: order processing, 2 to 4 working days (Saturdays and public holidays are not considered working days). Once the order has been processed, Swiss Post will forward the parcel.

EVIDENTIELLE SARL collaborates with the Swiss Post Office for the delivery of products, according to the formula chosen by the customer for the shipment, it is impossible to manage particular requests concerning changes of delivery, parcels to be delivered at precise times and other specific requests.

We accept no liability for delivery, particularly in the following cases:

- Return of parcels following an address error or an incomplete address. The parcel may be reshipped upon payment of a new delivery charge.
- Return of parcel due to non-recovery of the parcel within the time limit set by the delivery service provider. A new parcel may be dispatched at the customer's request, subject to new invoicing at the customer's expense. 

EVIDENTIELLE SARL declines all responsibility from the moment the parcel is delivered by the Post Office.

Claims

If the Products delivered do not conform in nature or quality to the specifications indicated in the order, complaints must be sent to info@evidentielle.ch within 48 hours of receipt of the Products. After this period, no claim can be taken into account.

The return of goods must be preceded by the acceptance of a return request submitted by the Customer to info@evidentielle.ch.

Returns should be sent to the following address: EVIDENTIELLE SARL, Chemin des Acacias 5, 2114 Fleurier. Non-conforming goods must be returned in their original, unopened packaging.

Data protection

EVIDENTIELLE SARL undertakes to process your personal data relevant to each order in accordance with the relevant legal provisions on data protection for the purpose of fulfilling the contract.
